1. SESSION DETAILS
The Photographer agrees to provide a Mini Photography Session to the Client on one of the following preset dates, subject to availability. Session times are confirmed via Calendly after booking. Sessions are scheduled back-to-back and strictly timed.


2. SESSION PACKAGE
Duration: 15 minutes
Included Images: 5 professionally edited digital images
Additional Images: Available for purchase at $16 per image
Session Fee: $125 CAD, payable in full at the time of booking via ThriveCart


3. ARRIVAL & TIMING
The Client agrees to arrive at least 5 minutes prior to their scheduled session time. Sessions will begin and end at the scheduled time regardless of late arrival. Time lost due to lateness will not be extended or refunded.



4. HOME STUDIO ACKNOWLEDGEMENT AND ASSUMPTION OF RISK
The Client acknowledges that the session will take place at the Photographer’s home studio. The Client agrees to exercise caution when entering, exiting, and parking near the premises. The Photographer is not responsible for any damage to vehicles or personal property.

The Client further acknowledges that La Luz Studios is a pet-friendly home. While reasonable efforts are made to maintain a clean and allergen-reduced environment, the Photographer cannot guarantee an allergen-free space. The Client assumes all responsibility for any allergic reactions or sensitivities that may occur.

By attending the session, the Client voluntarily assumes all risks associated with participating in a home-based photo session, including but not limited to tripping hazards, animal exposure, and property-related injuries.



5. RELEASE OF LIABILITY AND INDEMNITY
The Client understands and agrees that participation in a home-based photo session involves certain inherent risks, including but not limited to personal injury, allergic reactions, or property damage.

By signing below, the Client voluntarily assumes all such risks and agrees to release, indemnify, and hold harmless La Luz Studios, the Photographer (Jacqueline Cittadino), her family members, and any representatives from all actions, claims, demands, or causes of action arising out of or connected with participation in the photography session or presence on the premises.

The Client further agrees not to bring any claim or legal action against La Luz Studios or the Photographer for any injury, illness, or loss that may occur before, during, or after the session, whether arising from negligence or otherwise, to the fullest extent permitted by Ontario law.


6. CANCELLATION & RESCHEDULING POLICY
Mini Sessions are non-refundable and non-transferable to other session types. Rescheduling is only permitted in the event of severe weather (as determined by the Photographer) or a personal emergency, at the Photographer’s discretion.

If the Photographer must cancel due to illness, emergency, or unforeseen circumstances, the Client will be offered a rescheduled date or a full refund.


7. DELIVERY OF IMAGES
The Client will receive a private online gallery within 1–2 weeks of their session. The Client may select their 5 included images for download and may purchase additional images. Galleries remain active for 14 days.


8. COPYRIGHT & USAGE
All images remain the sole property of La Luz Studios and are protected under Canadian copyright law. The Client is granted a personal-use license to print, post, and share images. Commercial use, resale, or editing of images without written consent is prohibited.

The Photographer retains the right to use any images from the session for portfolio, website, social media, and promotional purposes unless otherwise agreed in writing.

By booking this session, the Client grants La Luz Studios the irrevocable right to use and publish photographs from this session for editorial, promotional, advertising, website, and other marketing purposes, in any manner or medium. The Client releases La Luz Studios from all claims or liability relating to the use of said photographs.

If minors are photographed, the Client affirms they are the legal parent or guardian and have authority to grant this release on their behalf.

Clients who do not wish for their images to be used for promotional purposes must notify La Luz Studios in writing prior to the session.


9. LIMITATION OF LIABILITY
In the unlikely event of equipment failure, data loss, or any unforeseen incident beyond the Photographer’s control, liability is limited to the return of all payments received.

The Photographer is not responsible for accidents, injuries, allergic reactions, or property damage sustained before, during, or after the session. The Client agrees to hold harmless and release La Luz Studios, the Photographer, and her household from any and all claims, damages, or liability resulting from participation in the session.

The Photographer is also not responsible for the behavior of children, unwilling participants, or uncontrollable circumstances such as lighting or weather. Every reasonable effort will be made to create beautiful images regardless of conditions.


10. AGREEMENT & GOVERNING LAW
By booking this session and submitting payment, the Client confirms they have read and understood the terms outlined above and agree to be bound by them.

This agreement is governed by and construed in accordance with the laws of the Province of Ontario. Any disputes shall be handled within the jurisdiction of Ontario courts.
